TERMS OF SERVICE

By commissioning me, you are automatically accepting my Terms of Service listed below. You, the client, agree that you have read and accepted all the terms described. You are only paying for my service as an artist. You will recieve digital goods only. You must be at least 18 years of age.Payment:
- I, the service provider, will give you a fixed estimate on the commission price at the beginning of our transaction.
- Payment method only includes PayPal for now.
- You, the client, must pay a minimum of 50% upfront before my drawing process will start.
- Full upfront payments are also possible. Please ask in advance.
- You, the client, will be notified by me via PayPal's invoice system.
- What you see on the invoice is what you will have to pay. PayPal fees are covered by me.
- Payment must be sent within the first 3 days after recieving your invoice unless negotiated otherwise.
- A different client may take your place if the first payment isn't fulfilled on time.
- The remaining amount needs to be paid around halfway through the drawing process.
- Paying the remaining amount only after the illustration has been finished is not an option.
- My prices are listed in EUR/€. You, the client, are responsible for any currency coversions.
- I am not responsible for any payment mistakes made by you.
- I have the right to withhold my work from being sent to you if payment isn't completed first.
- I will initiate all transactions. Please do not start any payments without my knowledge.Due to current laws regarding Value Added Taxes (VAT) in my home country, I need to inform you that my invoices do not contain VAT according to § 19 UStG (Last updated: 06.08.2023)Extra Fees:
- Depending on the difficulty of the commission, complexity fees may apply on top of the base price.
- Specific character designs, poses and backgrounds are a common part of a complexity fee.
- Fees are being evaluated and negotiated with the client individually before starting a commission.
- Please read the additional options listed in my price sheet carefully.
- In case you want to add something when I already initiated the drawing process, a new price can be negotiated.Backgrounds:
- As long as you don't communicate a specific background that you want, a simple gradient background or a flat color will be used.
- Simple geometric shapes and frames are possible as well.Refund Policy:
- You, the client, are required to contact me when you need to cancel a commission request.
- 100% refunds are possible before I start the drawing process.
- If you, the client, wishes to cancel your order in the middle of the drawing process, no refunds will be given.
- If you, the client, only paid the 50% upfront invoice, the remaining payment invoice will not be sent to you in case of a cancellation.
- If both invoices are already paid, no refunds will be given.
- If you, the client, have voluntarily opted for a full 100% upfront payment, only 50% will be refunded if I haven't reached the coloring stage.
- I will not refund any price differences caused by changing currency conversions on the client's side.
- If I decide to cancel a commission that I have already started, 100% of your payment will be refunded.Chargeback Policy:
- You, the client, are not authorized to issue a chargeback for any reason.
- If your payment service provider malfunctions or authorizes a refund request without your knowledge, you must contact me as soon as possible.If you, the client, purposefully issue a chargeback or refund without contacting me to cancel a commission, I will initiate an immediate block and blacklist for you as well as your contact information and your payment account.Progress:
- You, the client, will recieve progress images during the different stages of your commission (sketch, line art, flat color etc.).
- You, the client, can also request an update if you ask me.
- My response time varies from 1 to 5 days. Please be patient.
- You have the right to request an edit for our sketch before entering the next progress stages as long as your alterations don't make the character, pose or background more complicated than initially agreed on.
- No further edits can be made during the stages after the initial sketch. These may include changes in pose, expression, background, character or outfit.
- I reserve the right to charge you minor extra fees if we agree on edits exceeding a certain amount or complexity.
- Major errors that were caused by me during the drawing process are excluded from this policy (e.g. wrong color palette, two left hands, wrong character)
- Some commissions will take a few weeks or a couple of months depending on complexity, priority and my current life situation.
- I will not disclose any details about other projects or my private life that may be the reason for a delay in your commission.
- You are guaranteed to recieve your commission within a maximum of 6 months.
- Please be transparent in your commission request if you want a deadline.
- Ususally, no deadline will be given when starting a project.
- If I fail to deliver a commission within 6 months, you have the right to request a discount.
- Discounts will be discussed individually.
- A discount does not apply if the delays are caused by insuffient communication from your side.
- It is your responsibility to ensure that I follow the details that we have agreed upon.
- Any artistic critique is welcome unless it heavily restricts the art style that I am using. See the Capabilities & Exceptions list here.
- You can find your commission progress on my public list here.Finished Commissions:
- You will recieve a high resolution image of your finished commission at the end of the drawing process.
- These images will range roughly between 1800-5000 px at 600 dpi.
- Finished drawings will be sent via mail.
- Please save your recieved files as I am not responsible for storing the original data indefinitely.
- Occasionally, a time-lapse will be provided as well.
- If you don't want me to publish your commission on my social media pages, please let me know at the very beginning of your request.
- Unless stated otherwise, I reserve the right post or delete your finished commission on my social media sites.
- I am not required to post your project in any public space.
- There may be slight differences in the way I draw your commission compared to my portfolio works due to changing art skills or workflows over a longer period of time.
- You do not have the right to edit or commercially process my art.
- Credit is required if you want to post my illustration on other platforms.
- I will not redraw your commission after the final product has been finished.
- To make sure you have recieved your product, please respond to my messages.
- Any rude or defamatory comments about me or my art in a public space will result in blacklisting you as a client. Please be aware that this is different from a constructive art critique or feedback.Please be aware that your purchase is a digital good only! Nothing will be shipped or printed.Commercial Use
I have the rights to our commissioned art to display on different platforms if not stated otherwise by you. Commissions are not for commercial usage unless they were specifically made for commercial purposes. Commercial commissions will be negotiated individually.AI & NFT Usage
By accepting my services, you agree that you do not use the commissioned artworks to feed any sort of AI machine learning algorithms or similar software without my consent. Also, please do not use my art as NFTs (Non Fungible Tokens).
